Two Police Constables (D1 and D2) were today (Tuesday) charged by the ICAC with conspiracy to pervert the course of public justice over the soliciting and acceptance of unauthorised loans.

D1, 32, faces two counts of prescribed officer soliciting an advantage and two of prescribed officer accepting an advantage, contrary to Section 3 of the Prevention of Bribery Ordinance.

D1 and D2, 24, face a joint charge of conspiracy to pervert the course of public justice, contrary to the Common Law and Section 159A of the Crimes Ordinance.

The defendants will appear in Tuen Mun Magistracy at 9:30 am on Thursday (May 6) for plea.

The complaint was initially made to the Police, who subsequently referred the matter to the ICAC for investigation.

D1 is alleged to have solicited and accepted from D2 two loans of $5,000 and $2,000 respectively on February 1 and 20, 2009, without the general or special permission of the Chief Executive.

The remaining charge alleges that between June and November 2009, D1 and D2 conspired together to pervert the course of public justice by falsely representing to ICAC officers that it was a friend of D1, instead of D1 himself, who had solicited and accepted the above two loans from D2.

The defendants have been released on ICAC bail, pending their court appearance on Thursday.
