Prosecution Seminar in Brunei

Mr. Henry SO (Right) and two senior counsel from Hong Kong's Department of Justice attended the Prosecution Seminar in BruneiOn 18 & 19 June 2003 the Anti-Corruption Bureau (ACB) of the Prime Minister's Office of Brunei Darussalam held a prosecution seminar at their headquarters. The purpose was to provide an overview of the methods of investigation and prosecution of corruption offences as undertaken in Hong Kong. More specifically to study the offences of 'Misconduct in Public Office' and that committed by a public employee of having assets disproportionate to official emoluments. To this end two senior counsel from Hong Kong's Department of Justice, Mr. Ian McWalters and Mr. Kevin Zervos, together with Mr Henry SO, Chief Investigator ICAC Hong Kong, were invited to be speakers.

The seminar chairman, ACB Deputy Director, Mr Hj Abudulla, opened the seminar. He introduced the speakers to the audience of about sixty participants; most were ACB officers who were joined by government counsel from the office of the Director of Public Prosecutions and magistrates from the Judiciary. Mr. McWalters, leading the Hong Kong delegation, thanked the Chairman for the invitation and the seminar commenced with a presentation on the proactive approach to investigation especially using undercover operatives. Chief Investigator SO demonstrated the advantages through an illustration of a selected case followed by Mr Zervos who dealt with the subsequent prosecution.

This pattern was repeated during the two days and proved to be a successful formula with the audience showing particular interest in the misconduct cases. Experiences were exchanged and all too soon the allotted time had gone. The session was extended into the afternoon to enable further discussion in relation to problems encountered in Hong Kong in respect of the prosecution of such cases. The seminar was closed by Mr Hajah Intan, Director of ACB, who presented certificates to the speakers and remarked on the undoubted benefits gained by all parties when attending international seminars.
