Former legislator charged with disclosing identity of a subject of ICAC investigation

A former Legislative Councillor has been charged this morning (December 28) by the ICAC for allegedly disclosing the identity of a person under investigation by the Commission.
Upon receipt of complaints, the ICAC has investigated the alleged disclosure in accordance with the law and established procedures, and sought legal advice from the Department of Justice afterwards.
Lam Cheuk-ting, 43, faces three counts of disclosing identity of persons being investigated, contrary to Section 30(1)(b) of the Prevention of Bribery Ordinance (POBO).
The defendant will appear in the Eastern Magistrates’ Courts this afternoon for mention.
The charges allege that on each occasion on December 30, 2019, January 21 and July 16, 2020, the defendant, knowing or suspecting that an investigation in respect of an offence alleged or suspected to have been committed under Part II of the POBO was taking place, without lawful authority or reasonable excuse, disclosed to the public or a section of the public the identity of a subject person of such investigation.
The defendant has been released on ICAC bail, pending his court appearance this afternoon.
