Ex-supervisor of chain supermarket gets five months for accepting advantages

2006-12-18

A former supervisor of a chain supermarket, charged by the ICAC, was today (Monday) sentenced to five months’ imprisonment at Kwun Tong Magistracy for accepting free trips to Macao and night-club entertainment from a meat concessionaire.

Chan Kai-ming, 37, former area operations supervisor of Park'N Shop Limited (Park'N Shop), was earlier found guilty by Magistrate Ms Ida Lo of three counts of agent accepting an advantage, contrary to Section 9(1)(b) of the Prevention of Bribery Ordinance .

The court heard that at the time of the offences, a supplier had business dealings with the defendant in respect of meat stalls at Park'N Shop outlets.

On three occasions between July and October 2005, the meat concessionaire paid for the defendant's night-club coupon, which consisted of a round trip ferry ticket and a hotel room, when they visited Macao.

The defendant did not make payments to the concessionaire, and neither did he report to Park'N Shop his acceptance of the advantages from the supplier, the court was told.

Park'N Shop prohibited its employees from accepting advantages in relation to its business.

When interviewed under caution by ICAC officers, the defendant admitted accepting the advantages for showing favour to the supplier by ordering packing materials for the latter's meat stalls at Park'N Shop outlets, the court was told.

Park'N Shop had provided assistance to the ICAC during its investigation.

The prosecution was today represented by Government Counsel Ned Lai, assisted by ICAC officer Anita Ma.
