Duo jailed for bribery over cleaning orders and renovation contracts

The chairman of an incorporated owners of a residential building and a director of a construction company, charged by the ICAC, were today (Tuesday) sentenced at the District Court for bribery over cleaning orders of an industrial building and a renovatio n contract of a residential building.

Chan Shu-kong, 57, chairman of incorporated owners of Hong Lai Garden and executive officer of Fu Hang Industrial Building, received a jail term of two years, while Chan Kam-sang, alias Chan Che-kang, 44, director-cum-shareholder of Win Yat Construction ( H.K.) Company Limited (Win Yat), was jailed for 18 months.

Chan Shu-kong was earlier found guilty of five counts of agent soliciting an advantage and nine of agent accepting an advantage, while Chan Kam-sang was convicted of two counts of offering an advantage to an agent.

In sentencing, Deputy Judge Amanda Jane Woodcock said custodial sentences must be imposed on the defendants to reflect the seriousness of the bribery offences.

The court heard that between January 2004 and January 2005, Chan Shu-kong solicited a total of $10,000 and accepted the bribes from the proprietor of an environmental protection service company.

The bribes were rewards for Chan Shu-kong to place manholes cleaning orders of Fu Hang Industrial Building with the environmental protection service company.

The court also heard that on October 5, 2004, Chan Kam-sang offered a TV set to Chan Shu-kong as a reward for persuading the committee members of the incorporated owners of Hong Lai Garden not to conduct another tendering exercise in relation to a renovat ion contract, but to put forward the four short-listed contractors, including Win Yat, to the general meeting of the owners of Hong Lai Garden for final selection.

Chan Shu-kong accepted the TV set, and subsequently accepted a free tour to Thailand from Chan Kam-sang for the same reason.

On April 9, 2005, Chan Kam-sang offered $5,000 to Chan Shu-kong as a reward for the latter's assistance in procuring the renovation contract of Hong Lai Garden for Win Yat.

Chan Shu-kong accepted the bribe payment and another $5,000 from Chan Kam-sang for the same reason, the court was told.

The prosecution was today represented by Senior Government Counsel Peter Daryanani, assisted by ICAC officer Wilson Sim.
