CSD officers charged with misconduct over supervision of discharged inmates

Three officers of the Correctional Services Department (CSD) have been charged by the ICAC for alleged misconduct by assisting 16 discharged inmates in evading detection of abuses of dangerous drugs during statutory supervision periods.

Tang Kwai-man, 48, Officer; Leung Siu-wing, 53, and Chan Chun-man, 52, both Assistant Officers I, who were charged yesterday (December 12), each faces one count of misconduct in public office, contrary to the Common Law.

The defendants will appear at Eastern Magistracy at 9:30 am tomorrow (December 14) for plea.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged misconduct offences.

At the material times, the defendants were posted to the Rehabilitation Unit of CSD. They were responsible for enforcing a one-year statutory supervision on discharged inmates of the Hei Ling Chau Addiction Treatment Centre (HLTC) under the Drug Addictio n Treatment Centre Ordinance.

The discharged inmates would be sent back to the HLTC for drug treatment under a Recall Order if they breached the conditions of supervision during the one-year statutory supervision period.

The charges allege that between November 14, 2008 and November 21, 2009, Tang, Leung and Chan, in the course of or in relation to their public offices, without reasonable excuse or justification, wilfully and seriously misconducted themselves by wilfully neglecting or failing to perform their duties of supervising 16 inmates released from the HLTC and subjected to supervision orders.

Tang, Leung and Chan are alleged to have failed to visit the inmates at their homes or work places; failed to submit Records of Supervision (ROS) after the visits; and/or submitted ROS with incorrect dates, times, places and participating officers of the visits.

Tang and Leung are also alleged to have absented themselves when the inmates provided their urine samples; and failed to record in the ROS that the inmates admitted they had taken dangerous drugs.

Leung is also alleged to have failed to deliver the urine samples provided by the inmates; and replaced the inmates’ urine samples with other persons’ samples for drug examination.

CSD has rendered full assistance to the ICAC during the investigation.

The defendants have been released on ICAC bail, pending their court appearance tomorrow.
