Legal executive charged and ex-policeman wanted for alleged graft over murder case

A legal executive of a solicitors firm has been charged by the ICAC with conspiracy for a policeman to solicit a bribe of $13,000 from a man for divulging information on the investigation of a murder case as well as deceiving legal fees, while the policem an, now retired, is wanted for his alleged role in the case.

Eddie Lai Yuk-leung, 55, a legal executive of Cheung, Chan & Chung Solicitors & Notaries (CCCS), who was charged yesterday (December 28), faces two charges –'96 one of conspiracy for a public servant to solicit an advantage, contrary to Section 4(2)(a) of the Prevention of Bribery Ordinance and Section 159A of the Crimes Ordinance; and one of fraud.

Lai, currently on ICAC bail, will appear at the Fanling Magistracy at 9:30 am tomorrow (December 30) for transfer to the District Court for plea.

At the material times, Wong Wing-kai, a Police Constable attached to the District Crime Squad of Tai Po District, was one of the officers tasked to investigate a case in which Pun Fuk-kwan was murdered in Fanling in June 2006.

The bribery charge alleges that between May 1 and September 8, 2007, Lai conspired with Wong and Kwan Kwok-leung to solicit $13,000 from Mok Shu-yik as a reward for Wong to divulge information on the police investigation in relation to the death of Pun. Mok was the father of two suspects in the murder case.

The fraud charge alleges that on September 14, 2007, Lai falsely represented to Mok that the fees for legal services provided by CCCS for his sons amounted to $22,000, and with intent to defraud, induced Mok to deposit the sum of money into the bank accou nt of Lai, which resulted in benefit to him.

The Police had rendered full assistance to the ICAC during its investigation.

Kwan, 31, a goods van driver, was earlier charged by the ICAC with one count of conspiracy for a public servant to solicit an advantage. He pleaded guilty to the charge at the District Court, and was remanded in the custody of the Correctional Services D epartment until January 5, 2012 for mention.

Upon the application of the ICAC, the Eastern Magistracy has issued a warrant for the arrest of Wong Wing-kai, 46, for his alleged involvement in the case, and ordered the forfeiture of his cash bail of $10,000.
