Ex-property agents in court for alleged bribery over flat sale

Two former property agents appeared at the Kowloon City Magistracy today (Friday) after being charged by the ICAC for their alleged roles in a conspiracy for one of them to accept an illegal rebate of $20,000 in relation to a property transaction.
Chan Man-chun, 36, and Lam Hoi-man, 37, both former account managers of 18 Property Agency Limited (18PA), who were charged on Wednesday (December 17), faced a joint charge of conspiracy for an agent to accept advantages, contrary to Section 9(1) of the P revention of Bribery Ordinance and Section 159A of the Crimes Ordinance.
The defendants pleaded not guilty to the charge. Principal Magistrate Peter Law Tak-chuen adjourned the case to January 30, 2015 for a pre-trial review.
At the material time, Chan and Lam were account managers posted to a branch of 18PA in Mongkok. Chan was responsible for handling a property transaction in which Lam was the vendor.
The charge alleged that between August 27 and September 4, 2013, Chan and Lam conspired together for Chan to, without lawful authority or reasonable excuse, accept a sum of $20,000 from Lam as a reward for assisting Lam in obtaining an exemption of paymen t of commission in the sale of the property located at Charming Garden, of which Lam was one of the joint owners.
Chan and Lam were each granted cash bail of $20,000. They were also ordered not to interfere with prosecution witnesses.
18PA had provided full assistance to the ICAC during its investigation.
The prosecution was today represented by ICAC officer Chris Chan.
