Ex-welder of engineering company charged with accepting $48,000 illegal ‘referral fees’

A former welder of an engineering company has been charged by the ICAC today (December 14) with accepting illegal “referral fees” totalling over $48,000 for referring two men to serve as construction workers for the company.

He Shidao, 49, former welder of Kong’s Engineering Company (KEC), faces seven charges of agent accepting an advantage, contrary to Section 9(1)(a) of the Prevention of Bribery Ordinance.

The defendant will appear at the West Kowloon Magistracy next Tuesday (December 18) for plea.

At the material time, the defendant was a welder of KEC, a subcontractor responsible for the drainage system installation works at various construction sites. In May 2016, the defendant was asked by the proprietor of KEC to introduce construction workers to work for the company.

Five of the charges allege that between September 12, 2016 and February 2, 2017, the defendant, without lawful authority or reasonable excuse, accepted a total of $45,600 as “referral fees” from a man as rewards for assisting him in securing and continuing his employment with KEC.

The remaining two charges allege that on December 30, 2016 and February 1, 2017, the defendant, without lawful authority or reasonable excuse, respectively accepted $500 and $2,600 as “referral fees” from another man for the same purpose.

KEC has rendered full assistance to the ICAC during its investigation into the case.

The defendant has been released on ICAC bail, pending his court appearance next Tuesday.
