Job seeker admits obtaining employments with property agencies by deception

A man, charged by the ICAC, admitted at the Shatin Magistracy today (December 21) that he had obtained employments with two property agencies by using false representations and academic proofs, thereby inducing the property agencies to pay him salaries totalling over $30,000.

Au Kam-cheong, 21, pleaded guilty to two charges of obtaining a pecuniary advantage by deception, contrary to Section 18(1) of the Theft Ordinance. The prosecution offered no evidence to a similar charge against him.

Magistrate Ms Winnie Lau Yee-wan adjourned the case to January 24 next year for sentence, pending a community service order report. The defendant was granted bail.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above offences.

The court heard that on March 2, 2016, the defendant applied to Ricacorp Properties Limited (Ricacorp) for the post of sales trainee.

In a job interview, the defendant falsely represented that he had completed Form 6 secondary education at a secondary school in Hong Kong, and submitted to Ricacorp a forged graduation certificate purportedly issued by that school.

As a result, Ricacorp employed the defendant to work as a sales trainee with effect from March 10, 2016 at a monthly salary of $5,900.

On April 18, 2016, Ricacorp terminated the employment of the defendant because he ceased to go to work. The total amount of salary paid to the defendant was over $8,100 during the period of employment.

The court heard that on March 23, 2017, the defendant applied for the post of sales trainee with Centaline Property Agency Limited (Centaline).

In a job interview, the defendant falsely represented that he had completed Form 5 education at the above-mentioned secondary school and had never been found guilty of any offence in Hong Kong, and submitted to Centaline a forged graduation certificate purportedly issued by that school.

As a result, Centaline employed the defendant to work as a sales trainee with effect from March 29, 2017 at a monthly salary of $5,000 to $5,500. The defendant resigned on July 7, 2017. The total amount of salary paid to him was over $22,800 during the period of employment.

ICAC enquiries revealed that the defendant was never a student of the above-mentioned secondary school. At the material time, he only received Form 1 education at two other secondary schools, the court was told.

Ricacorp and Centaline had rendered full assistance to the ICAC during its investigation into the case.
