Duo charged with fraud over fire service installation contractor registration

A director of a fire services engineering company and an engineer have been charged by the ICAC today (December 20) with conspiracy to defraud the Fire Services Department (FSD) in relation to the company’s registration as a fire service installation contractor.
Cheung Yuen-wa, 44, director and sole shareholder of Chung Kwun F.S. Eng. Co. Limited (Chung Kwun), and Tsang Yiu-man, 48, former senior engineer of a telecommunication company, face a joint charge of conspiracy to defraud, contrary to Common Law.
The defendants will appear at the West Kowloon Magistracy next Tuesday (December 24) for plea.
The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offence.
Under the Fire Service (Installation Contractors) Regulations, a company applying for registration as a Fire Service Installation Contractor in Class 1 (FSIC) must retain a Qualified Person, who is a director, partner or employee holding a qualified degree in electrical engineering.
At the material time, Cheung was the director and sole shareholder of Chung Kwun, a registered FSIC which engaged in the business of fire services engineering. Tsang was a full-time engineer of a telecommunication company. Cheung came to know Tsang in around 2015 or 2016 when a project of the telecommunication company was awarded to Chung Kwun.
The charge alleges that Cheung and Tsang conspired together between about February 9 and June 4, 2018 to defraud the FSD.
It is alleged that they have dishonestly falsely represented in an application form and other supporting documents submitted to the FSD for Tsang to be added as a Qualified Person of Chung Kwun in respect of its registration as an FSIC that Tsang was an employee of the company since November 2017, and induced the FSD to believe that Tsang was its genuine employee in considering the application.
The FSD has rendered full assistance to the ICAC during its investigation into the case.
The defendants have been released on ICAC bail, pending their court appearance next Tuesday.
