MIPO case defendant faces additional perversion charge

A defendant, who was earlier charged by the ICAC for allegedly conspiring with two officers of the Correctional Services Department (CSD) and others to commit misconduct in public office (MIPO) for conniving at his unauthorised possession and use of a mobile phone in a prison, is today (March 29) laid with an additional perversion charge regarding an investigation and disciplinary proceeding conducted by the CSD.
Lau Yin-chun, 28, unemployed, faces an additional charge of conspiracy to doing an act tending and intended to pervert the course of public justice, contrary to Common Law and Section 159A of the Crimes Ordinance.
The case arose from a corruption complaint referred by the CSD. Subsequent ICAC enquiries revealed the above alleged offences.
Lau, now discharged, was an inmate of Tong Fuk Correctional Institution (TFCI) at the material time.
The additional charge alleges that between August 18 and 20, 2020, Lau conspired with another then inmate of TFCI to pervert the course of public justice by having the inmate present himself, in substitution for Lau, as a participant of a betting game that took place in a dormitory of TFCl in the investigation conducted by the CSD in respect of the breach of the Prison Rules; and having the inmate admit to being the participant of the betting game in the disciplinary proceeding held by the CSD.
Lau, together with four co-defendants charged by the ICAC in January 2021, will appear at the West Kowloon Magistrates’ Courts on Thursday (April 1) for their case to be transferred to the District Court for plea.
The four co-defendants are Yeung King-lun, 43, Assistant Officer I of the CSD, and Lee Ho-wai, 26, Assistant Officer II of the CSD, both formerly posted to TFCI; and Cheung Yui-ming, 36, and Lam Hon-ki, 23, both former inmates incarcerated in TFCI and discharged.
Lau and Yeung jointly face one count of conspiracy to commit MIPO, which alleges that between July 16 and October 23, 2020, the duo conspired together for Yeung to wilfully and intentionally misconduct himself in the course of or in relation to his public office, without reasonable excuse or justification, by conniving at the unauthorised possession and use of a mobile phone in TFCI by Lau as an inmate, and rendering assistance to Lau in improving the signal reception of a SIM card used in the mobile phone at TFCI.
Lau, Lee, Cheung and Lam jointly face another count of conspiracy to commit MIPO, which alleges that between July 16 and October 23, 2020, they conspired together for Lee to wilfully and intentionally misconduct himself in the course of or in relation to his public office, without reasonable excuse or justification, by conniving at the unauthorised possession and use of a mobile phone in TFCI by Lau as an inmate, and introducing unauthorised cigarettes into TFCI for Lau.
The CSD has rendered full assistance to the ICAC during its investigation into the case.
