Man faces additional charges over 2015 DC Election

A person, who was earlier charged by the ICAC with bribing prospective candidates of the 2015 District Council (DC) Election, was today (Friday) laid with three additional charges when he appeared at the Eastern Magistracy.

Cheng Wing-kin, 31, a waiter, faced three additional charges – two of engaging in corrupt conduct at an election, contrary to Section 7(1)(a) and Section 7(1)(c) of the Elections (Corrupt and Illegal Conduct) Ordinance (ECICO) respectively; and one of conspiracy to engage in corrupt conduct at an election, contrary to Section 7(1)(g) of the ECICO and Section 159A of the Crimes Ordinance.

Cheng now faced a total of eight charges, including the three additional charges laid against him today.

One of the additional charges alleged that on July 29, 2015, Cheng engaged in corrupt conduct at the 2015 DC Election by offering $150,000 to a person as an inducement for that person to stand as a candidate at a specified geographical constituency of the election.

Another charge alleged that between July 12 and September 24, 2015, Cheng engaged in corrupt conduct at the election by offering a sum of not less than $10,000 to another person as an inducement for that person to get a third person to stand as a candidate at a specified geographical constituency of the election.

The remaining charge alleged that between July 12 and August 9, 2015, Cheng conspired with Ku Ka-ho, Chan Kin-loong and another person for Ku to engage in corrupt conduct at the election by accepting from Cheng a sum of money between $150,000 and $200,000 as an inducement for Ku to get Chan to stand as a candidate at a specified geographical constituency of the election.

Ku, 32, a renovation worker, and Chan, 37, a merchant, who were also charged by the ICAC with a joint count of conspiracy to engage in corrupt conduct at the election, appeared at the Eastern Magistracy in a separate case for mention today.

No plea was taken from Cheng, Ku and Chan today. Upon an application from the prosecution, Principal Magistrate Ms Bina Chainrai adjourned the two cases to December 21 this year for mention, pending transfer to the District Court.

Cheng was granted cash bail of $3,000, while Ku and Chan were on cash bail of $10,000 each. They were also ordered to surrender their travel documents, not to leave Hong Kong, report to the Police thrice a week, and not to interfere with prosecution witnesses.

The prosecution was today represented by Acting Senior Assistant Director of Public Prosecutions Beney Wong, assisted by ICAC officer Vani Wan.
