Man charged for alleged voting offences at Rural Representative Election

A registered voter has been charged by the ICAC today (Monday) for allegedly committing voting offences at the 2015 Rural Representative (Resident Representative) Election for Mai Po Tsuen in Yuen Long.

Sammy Leung Hon-sang, 39, operation supervisor of a logistics company, faces two counts of engaging in corrupt conduct with respect to voting at an election, contrary to Sections 16(1)(a) and 16(1)(b)(i) of the Elections (Corrupt and Illegal Conduct) Ordinance respectively.

The defendant will appear at the Tuen Mun Magistracy on Wednesday (January 6) for plea.

At the material time, the defendant was a registered elector of the Rural Representative (Resident Representative) Election for Mai Po Tsuen, which was held in San Tin, Yuen Long on January 18, 2015.

ICAC enquiries revealed that in the application for voter registration received by the Home Affairs Department (HAD) on July 16, 2014 in respect of the defendant, an address in Mai Po Tsuen was provided as his principal residential address. In fact, he had never stayed overnight in Hong Kong since January 1, 2011, so he was not eligible to register as an elector.

One of the charges alleges that on January 18, 2015, the defendant engaged in corrupt conduct at the election by voting at it knowing that he was not entitled to do so.

The other charge alleges that on the same day, the defendant engaged in corrupt conduct at the election by voting at it after having given to an Electoral Registration Officer information that he knew to be materially false or misleading, namely the address appearing in the Voter Registration Form submitted to the HAD in his name was his sole or main home in Hong Kong.

The HAD had rendered full assistance to the ICAC during its investigation.

The defendant has been released on ICAC bail, pending his court appearance on Wednesday.
