Elector charged for alleged voting offence at Rural Representative Election

A registered elector has been charged by the ICAC today (Wednesday) for allegedly committing a voting offence at the 2015 Rural Representative (Resident Representative) Election for Tai Tong in Yuen Long.

Leung Chung-sau, 59, Acting Senior Hawker Control Officer of the Food and Environmental Hygiene Department, faces one count of engaging in corrupt conduct with respect to voting at an election, contrary to Section 16(1)(a) of the Elections (Corrupt and Illegal Conduct) Ordinance.

The defendant will appear at the Tuen Mun Magistracy on Friday (January 22) for plea.

At the material time, the defendant was a registered elector of the 2015 Rural Representative (Resident Representative) Election for Tai Tong in Shap Pat Heung, Yuen Long, which was held on January 18, 2015.

ICAC enquiries revealed that on March 10, 2003, the defendant submitted to the Home Affairs Department an application for voter registration, in which he provided an address in Tai Tong as his principal residential address. He was successfully registered as an elector.

Subsequent ICAC enquiries revealed that the defendant had resided at a flat outside Tai Tong since 2006, so he was no longer eligible to vote at the 2015 Rural Representative (Resident Representative) Election for Tai Tong.

The charge alleges that on January 18, 2015, the defendant engaged in corrupt conduct by voting at the 2015 Rural Representative (Resident Representative) Election for Tai Tong knowing that he was not entitled to do so.

The defendant has been released on ICAC bail, pending his court appearance on Friday.
