Then-Police Constable charged by ICAC for breaching anti-bribery law over acceptance of unauthorised loan from subject in concluded case

A then Police Constable was charged by the ICAC yesterday (November 20) with an offence under the Prevention of Bribery Ordinance (POBO) for allegedly accepting an unauthorised loan of $15,000 from a person (the subject) previously involved in Police enquiries handled by him.
Mak Kwok-hung, 49, then Police Constable, faces one count of prescribed officer accepting an advantage, contrary to section 3 of the POBO. The defendant was released on ICAC bail, pending his appearance at the Eastern Magistrates’ Courts on Friday (November 22) for mention.
The illicit activity of the defendant was revealed in the course of an ICAC corruption investigation, which is still ongoing.
At the material time, the defendant was a Police Constable posted to a District Investigation Team of Central District. In September 2021, he came to know a subject under investigation in a theft probe handled by him. The case was concluded after about six months and the duo did not maintain any contact since then. On November 29, 2022, the defendant initiated to meet with the subject and solicited a loan from the latter.
It is alleged that the defendant, without the general or special permission of the Chief Executive, accepted a loan of $15,000 from the subject of the theft probe.
The Police had rendered full assistance to the ICAC during its investigation into the case.
