Eight charged by ICAC for using false overseas driving licences to apply for direct issuance of HK driving licences with TD without taking tests

Eight men were charged by the ICAC today (November 19) for allegedly deceiving the Transport Department (TD) into directly issuing Hong Kong driving licences to them without taking local driving tests by making false representations that they were holders of driving licences issued by a recognised country.

Ibrahim Muhammad, Khan Usman, Khan Mushed, Singh Dawinder Dip, Falaq-sher, Ong Jomari Perfinan, Ahmed Waseem and Basmer Hatim Hassan Awadh, aged between 21 and 47, were each charged in a separate case with one count of conspiracy to defraud, contrary to the Common Law.

The alleged offences were revealed in an ICAC investigation stemming from a corruption complaint. The eight defendants were released on ICAC bail, pending their appearance at the Eastern Magistrates’ Courts on Friday (November 21) for plea.

Under the arrangement of “direct issue of a Hong Kong Full Driving Licence without test” (the direct issue arrangement), the TD would directly issue a Hong Kong Full Driving Licence to a holder of a driving licence issued by one of the recognised countries and places, including Pakistan, without taking a local driving test.

The charges allege that between May 2022 and August 2023, each of the defendants conspired with other persons to defraud the TD by dishonestly falsely representing that they were eligible for the direct issue arrangement, inducing the TD to grant Hong Kong Full Driving Licences to them.

It was revealed in the ICAC investigation that the eight defendants in fact did not have any driving licence issued by any Pakistani authority. They had allegedly conspired with others to defraud the TD by submitting false Pakistani driving licences and relevant supporting documents to obtain Hong Kong Full Driving Licences through the direct issue arrangement.

The TD rendered full assistance to the ICAC during its investigation into the cases, and immediately revoked Hong Kong driving licences of the eight defendants following ICAC’s enforcement actions in 2023.

The ICAC has always maintained close contact with TD and provide anti-corruption advice. In view of the present cases, the ICAC is focusing on reviewing the practices and procedures related to the direct issue of Hong Kong Full Driving Licence, with the aim of curbing any bribery and other malpractices.
