Three charged and two wanted by ICAC for allegedly breaching ECICO by inciting others not to vote at LegCo Election

Two men and one woman were charged by the ICAC this morning (November 20) for allegedly reposting online posts which incited others not to vote at the 2025 Legislative Council General Election (LegCo Election) during the election period. The case is set for mention in the West Kowloon Magistrates’ Courts this afternoon. Meanwhile, warrants for the arrest of two men who published the posts in the first place were issued by a Magistrate.

The ICAC last Friday (November 14) arrested three individuals on suspicion of breaching section 27A of the Elections (Corrupt and Illegal Conduct) Ordinance (ECICO). Pursuant to the legal advice from the Department of Justice, the Commission today laid charges against the three arrestees in three cases.

The defendants are Wong Kin-kwok, 55, air-conditioning engineer; Lam Kin-sik, 66, unemployed; and Bonney Ma Wai-ling, 61, housewife. Each of them faces one count of engaging in illegal conduct to incite another person not to vote by activity in public during election period, contrary to section 27A(1)(a) of the ECICO.

The charges allege that during the election period of the 2025 LegCo Election, each of Wong, Lam and Ma reposted on their respective social media pages a post which incited another person not to vote at the election.

The 2025 LegCo Election was open for nominations from October 24 this year. According to the ECICO, the period between that day and the polling day (December 7, 2025) was the “election period” of the election.

The ICAC investigation revealed that Keung Ka-wai and Tong Wai-hung had published on their social media pages posts which incited others not to cast any votes in the 2025 LegCo Election. Subsequently, Wong reposted Keung’s post on his social media page, while Lam and Ma posted Tong’s post on their respective social media pages.

Meanwhile, warrants for the arrest of Keung and Tong, who had left Hong Kong, were issued by a Magistrate this morning upon applications by the ICAC.

Keung Ka-wai, 34, and Tong Wai-hung, 44, are each facing two counts of engaging in illegal conduct to incite another person not to vote by activity in public during election period, contrary to section 27A(1)(a) of the ECICO.

The charges allege that during the election period of the 2025 LegCo Election, the duo displayed on their respective social media pages posts which incited another person not to vote at the election.

The ICAC strongly condemns criminals who attempted to interfere with and undermine the current LegCo Election by circulating messages online to incite others not to vote. The Commission reiterates that publicly inciting others not to vote or to cast an invalid vote during the election period may contravene section 27A of the ECICO, while reposting related illegal content also constitutes a breach. The ICAC urges members of the public to strictly adhere to the law and distinguish the truth to avoid being fooled and exploited by lawbreakers.

The LegCo Election will be held soon. Voting is a civic responsibility for every elector. Responsible for enforcing the ECICO, the ICAC will uphold a clean election. The Commission will resolutely prevent and combat any conduct which might interfere with and undermine the election, and will ensure that the election will be conducted fairly, openly and honestly.
