Four more arrested by ICAC for allegedly inciting others not to vote or cast invalid votes at LegCo Election

The ICAC today (December 4) arrested four men for allegedly reposting an online post or leaving comments on social media platforms to incite others not to vote or to cast invalid votes at the 2025 Legislative Council General Election (LegCo Election) during the election period, in contravention of section 27A of the Elections (Corrupt and Illegal Conduct) Ordinance (ECICO). The ICAC had earlier charged three other individuals with the offence in relation to the current LegCo Election.

The four arrestees are aged between 37 and 62. The ICAC will pursue the case in accordance with the law and established procedures, and will seek legal advice from the Department of Justice on prosecution upon completion of the investigation.

The ICAC reiterates that publicly inciting others not to vote or to cast invalid votes during the election period is a violation of section 27A of the ECICO. Since the new provision under section 27A of the ECICO was introduced in 2021, a total of 12 people were convicted of the offence.

Responsible for enforcing the ECICO, the ICAC is determined to uphold a clean election and will not tolerate anyone to interfere with the election. The Commission will take resolute enforcement actions to ensure that the election will be conducted safely, fairly, openly and honestly.
