Project manager in court over accepting $75,000 illegal rebates to award flooring works

A project manager of an engineering company appeared in the Shatin Magistracy today (March 28) after being charged by the ICAC with accepting illegal rebates totalling $75,000 from a subcontractor in relation to the award of balcony flooring works at a private housing estate.

Lui Man-tak, 37, project manager of Gallant Art Contracting Engineering Limited (Gallant Art), who was charged last Friday (March 24), faced five counts of agent accepting an advantage, contrary to Section 9(1)(b) of the Prevention of Bribery Ordinance (POBO).

No plea was taken today. Acting Principal Magistrate Mr Joseph To Ho-shing adjourned the case to April 25 this year for plea.

At the material time, Lui was a project manager of Gallant Art, a contractor for the supply and installation work of wooden floorboards at balconies of nine of the blocks (the flooring works) at a private housing estate in Wu Kai Sha.

Yiu Kei-shing was the sole proprietor of Wa Shing Metal Design and Landscaping Company (Wa Shing), which was engaged in flooring works.

The charges alleged that on five occasions between November 18 and December 31, 2015, Lui, without lawful authority or reasonable excuse, accepted rebates of $75,000 in total from Yiu as rewards for awarding the flooring works to Wa Shing. The flooring works were said to be worth over $1.4 million.

Lui was granted cash bail of $10,000. He was also ordered not to leave Hong Kong, report to the Police once a week, and not to interfere with prosecution witnesses.

The prosecution was today represented by ICAC officer Kelly Ng.

Meanwhile, Yiu, 35, was also charged by the ICAC for his role in the scam in a separate case. He earlier pleaded guilty to five counts of offering an advantage to an agent, contrary to Section 9(2)(b) of the POBO.

Appearing in the Shatin Magistracy today, Yiu had his case adjourned by Magistrate Ms Ivy Chui Yee-mei to April 25 this year for sentence.

The prosecution was today represented by prosecuting counsel Selwyn So, assisted by ICAC officer Kelly Ng.
