Man charged for alleged breach of POBO by disclosing identity of person under ICAC probe

A man has been charged by the ICAC today (April 3) for allegedly breaching the Prevention of Bribery Ordinance (POBO) by disclosing the identity of a person under ICAC investigation.

Avery Ng Man-yuen, 40, business consultant, faces three charges of disclosing identity, etc. of persons being investigated, contrary to Section 30(1)(b) of the POBO.

The defendant will appear in the Eastern Magistracy this (April 3) afternoon for mention.

On April 2, 2016, Ng lodged a corruption complaint with the ICAC against a subject person and others.

The charges allege that between April 5 and May 24, 2016, the defendant, knowing or suspecting that an investigation in respect of an offence alleged or suspected to have been committed under Part II of the POBO was taking place, without lawful authority or reasonable excuse, disclosed to the public or a section of the public through social networking accounts and news media about the identity of the subject person under ICAC investigation and details of the ICAC investigation.

The defendant has been released on ICAC bail, pending his court appearance this afternoon.
