Six in court for perverting public justice and possessing dangerous drug

Six persons appeared in the Tuen Mun Magistracy today (May 19) after being charged by the ICAC with conspiracy to pervert public justice in a criminal intimidation case, while one of them also faced a charge of possessing a dangerous drug.

Cheng Wai-man, 37, Chan Ka-yan, 27, Chan Kwok-hung, 43, Chan Po-yu, 54, Chow Ka-man, 20, and Yeung Siu-yin, 55, who were charged on Monday (May 15), faced a joint charge of conspiracy to pervert the course of public justice, contrary to Common Law and Section 159A of the Crimes Ordinance.

Cheng Wai-man alone further faced a charge of possession of dangerous drugs, contrary to Section 8(1)(a) of the Dangerous Drugs Ordinance.

No plea was taken today. Acting Principal Magistrate Ms Merinda Chow Yin-chu transferred the case to the District Court for plea on June 8 this year.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offences.

At the material time, Cheng Wai-man was being investigated by the Police for his alleged role in a criminal intimidation case.

The joint charge alleged that between May 11 and June 25, 2015, the defendants conspired together to pervert the course of public justice by Cheng Wai-man seeking to have Chan Kwok-hung and Chan Po-yu induce Chan Ka-yan, through Chow Ka-man and Yeung Siu-yin, not to testify against Cheng Wai-man in the criminal intimidation case.

The other charge alleged that on January 19, 2016, Cheng Wai-man had in his possession a dangerous drug, namely 1.96 grammes of a crystalline solid containing 1.92 grammes of methamphetamine hydrochloride (commonly known as “ice”), at a room in Fu Tai Estate, Tuen Mun.

The Police had rendered full assistance to the ICAC during its investigation.

The prosecution was today represented by ICAC officer Fung Lee.
