Defeated candidate of DC Election in court for failing to lodge election return

A defeated candidate of the 2015 Kowloon City District Council (DC) Election (To Kwa Wan North Constituency) appeared at the Kwun Tong Magistracy today (June 15) after being charged by the ICAC with failing to lodge an election return as required by the Elections (Corrupt and Illegal Conduct) Ordinance (ECICO).

Shum Tai-fung, 25, legal clerk, who was charged yesterday (June 14), faced one count of failing to lodge an election return as required under Section 37 of the ECICO, contrary to Section 38 of the ECICO.

No plea was taken today. Principal Magistrate Mr Ernest Lin Kam-hung adjourned the case to July 14 this year for mention.

The case arose from a referral by the Registration and Electoral Office (REO). Subsequent ICAC enquiries revealed the above alleged offence.

At the material time, the defendant was a candidate of the 2015 DC Election for the To Kwa Wan North Constituency in Kowloon City District. He was defeated in the DC Election.

The charge alleged that on December 30, 2015, the defendant, being the candidate of the 2015 DC Election for the To Kwa Wan North Constituency, failed to lodge an election return as required under Section 37 of the ECICO.

The defendant was granted cash bail of $10,000. He was also ordered not to leave Hong Kong and not to interfere with prosecution witnesses.

The REO had rendered full assistance to the ICAC during its investigation.

The prosecution was today represented by ICAC officer Lai Yiu-wai.
