CSD officer and two others charged with conspiracy to MIPO

An Assistant Officer II (AO II) of the Correctional Services Department (CSD), a former inmate and his girlfriend have been charged by the ICAC today (July 24) with conspiracy to commit misconduct in public office (MIPO) in relation to the introduction of unauthorised articles into a prison for the inmate through corrupt assistance by the AO II.

Tsang Sin-sing, 44, AO II of the CSD; Wong Wai-leung, 36, former inmate of the Lai Chi Kok Reception Centre (LCKRC), and his girlfriend Kwok Sin-man, 32, face a joint charge of conspiracy to commit MIPO, contrary to Common Law.

Wong and Kwok also jointly face two alternative charges of conspiracy to offer an advantage to a public servant, contrary to Section 4(1)(a) of the Prevention of Bribery Ordinance (POBO) and Section 159A of the Crimes Ordinance, while Tsang alone faces two alternative charges of public servant accepting an advantage, contrary to Section 4(2)(a) of the POBO.

The defendants will appear at the West Kowloon Magistracy for plea on Wednesday (July 26).

At the material time, Tsang was an AO II of the CSD posted to its LCKRC. Wong was an inmate remanded in the LCKRC under the direct supervision of Tsang, while Kwok was his girlfriend who paid regular visits to him in the LCKRC.

The joint charge alleges that between November 6, 2016 and January 22, 2017, Tsang, Wong and Kwok conspired together for Tsang to wilfully misconduct himself in the course of or in relation to his public office, without reasonable excuse or justification, by Tsang:

• receiving from Kwok an unknown quantity of facial cleanser, gel mask, face cream and one lip balm stick for the purpose of bringing them into the LCKRC and passing them to Wong;

• bringing into the LCKRC unauthorised items or articles, namely facial cleanser and one lip balm stick, to Wong; and

• keeping one bottle of facial cleanser, one bottle of gel mask, strawberries and Japanese snacks received from Kwok for his own use and consumption.

Two alternative joint charges allege that on or about November 8, 2016 and January 19, 2017, Wong and Kwok conspired together to offer, without lawful authority or reasonable excuse, gifts of skin care products, strawberries and Japanese snacks to Tsang respectively as rewards for bringing unauthorised items or articles into the LCKRC to Wong.

The remaining two alternative charges allege that on or about the above two days, Tsang, without lawful authority or reasonable excuse, accepted those gifts from Kwok for the same purpose.

The CSD has rendered full assistance to the ICAC during its investigation.

The defendants have been released on ICAC bail, pending their court appearance on Wednesday.
