Four in court over using bogus quotations to secure $470,000 inspection and repair works

A former chairlady of the incorporated owners (IO) of an industrial building and three maintenance contractors appeared in the Kowloon City Magistracy today (August 8) after being charged by the ICAC with conspiracy to use bogus quotations to help an engineering company secure over $470,000 worth of mandatory building inspection and necessary repair works at the industrial building.

The defendants, who were charged last Thursday (August 3), were Stella Lam Sui-lin, 65, former chairlady of the IO of Fuk Hong Industrial Building; Yeung Ho-ki, 39, sole proprietor of Key Power Water-proof Engineering Company (KPW); Lam Kwai-lung, 28, partner of O&H Design House (O&H); and Yau Tai-hung, 48, director of Ho Hin Engineering (HK) Limited (HHE).

They faced a joint charge of conspiracy to use false instruments, contrary to Sections 73 and 159A of the Crimes Ordinance.

No plea was taken today. Principal Magistrate Mr Peter Law Tak-chuen adjourned the case to October 6 this year for mention.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offence.

At the material time, Stella Lam was the chairlady of the IO of Fuk Hong Industrial Building in Tong Mi Road, Mong Kok. Yeung, Lam Kwai-lung and Yau were respectively the sole proprietor of KPW, a partner of O&H and a director of HHE.

In December 2014, the Buildings Department issued a notice to the IO of Fuk Hong Industrial Building requiring it to conduct mandatory building inspection and necessary repair works at the industrial building.

The charge alleged that between September 9 and 22, 2015, Stella Lam, Yeung, Lam Kwai-lung and Yau conspired together and with Chan Sze-ka and Ma Kam-sing to use quotations from Shine Engineering Service Company (SES), KPW, O&H and HHE, which were and which they knew or believed to be false, with the intention of inducing somebody to accept them as genuine.

As a result, over $470,000 worth of the mandatory building inspection and necessary repair works of the industrial building were awarded to the engineering company.

The defendants were granted cash bail of $5,000 each, and ordered not to interfere with prosecution witnesses.

Chan, 34, and Ma, 31, were directors of Sky Win Engineering Limited, while Ma was also the sole proprietor of SES. They were also charged by the ICAC for their roles in the scam in a separate case. After pleading guilty to a joint charge of conspiracy to use false instruments, they had their case adjourned to this Friday (August 11) for mention.

The IO of Fuk Hong Industrial Building had rendered full assistance to the ICAC during its investigation.
