EMSD Works Supervisors and supplier charged by ICAC face additional bribery charges over gifts worth $3.2m

The ICAC earlier charged two Works Supervisors of the Electrical and Mechanical Services Department (EMSD) and one supplier with conspiracy to defraud for allegedly procuring the award of various purchase orders totalling over $13.6 million to the supplier and inflating the quantity and price of the items to be purchased. Pursuant to legal advice from the Department of Justice (DoJ) following further investigation by the Commission, the trio faced three additional corruption charges and one additional charge of conspiracy to defraud involving over 300 gifts worth about $3.2 million when the case was brought to mention at the West Kowloon Magistrates’ Courts today (July 23).
Tsang Tak-keung, 58; Yip Wai-ho, 52, both Works Supervisors I posted to the Health Sector Division of the EMSD; and Cheung Chun-kit, 67, operator of three suppliers, were earlier charged with two counts of conspiracy to defraud, contrary to the Common Law. The companies operated by Cheung were Leader Med Technology Limited, Hi Quali Trading Company and Smartechnique Services Company.
Magistrate Ms Shirley Cornelia Hung today allowed the prosecution’s application to lay four additional charges against the three defendants. The additional charges are two counts of conspiracy for a public servant to accept advantages and one count of public servant accepting an advantage, contrary to section 4(2)(a) of the Prevention of Bribery Ordinance and section 159A of the Crimes Ordinance; and one count of conspiracy to defraud.
The case was adjourned to November 9 for mention while the prosecution will apply to transfer the case to the District Court for plea. The defendants were granted bail.
At the material time of the offences between January 2017 and June 2024, Tsang and Yip were respectively responsible for providing maintenance services to Queen Elizabeth Hospital and the Yau Ma Tei Jockey Club Polyclinic. Their responsibilities included contacting suppliers for quotations of machinery parts used in the works and compiling internal quotation vetting documents (the Quotation Documents).
According to the EMSD’s procurement guidelines, the duo were required to invite more than one supplier for quotations for the purchase of items valued at or below $50,000. As general practice, three quotations should be obtained from different suppliers in each procurement exercise.
Tsang and Cheung were earlier charged with conspiracy to defraud the EMSD to make payments to the three companies of Cheung. The duo allegedly falsely represented that the three companies were respectively the lowest bidder in a procurement involving the purchase of items valued at or below $50,000, inflated the quantity and price of the items to be purchased, and made false representations that the information contained in the Quotation Documents was true and accurate.
An additional charge alleges that Tsang accepted advantages from Cheung for remaining favourably disposed to Cheung and his associated companies. It was revealed in ICAC investigation that Tsang allegedly accepted over 200 gifts worth a total of over $1.2 million from Cheung. At the material time of the offences, the EMSD awarded about 180 purchase orders in a total sum of over $8 million to the three companies of Cheung.
Two other additional charges allege that Tsang accepted a fish tank worth about $1,000 from another supplier for remaining favourably disposed to the latter, and conspired with the supplier to defraud the EMSD into making payments to the supplier by similar fraudulent means. The procurement involved a purchase order of about $40,000.
Yip and Cheung were earlier charged with conspiracy to defraud the EMSD to make payments to the three companies of Cheung by similar fraudulent means. An additional charge alleges that Yip accepted advantages from Cheung for remaining favourably disposed to Cheung and his associated companies.
Enquiries by the ICAC revealed that Yip allegedly accepted over 100 gifts worth totalling about $2 million from Cheung. The relevant procurements involved approximately 140 purchase orders in a total sum of about $5.6 million.
Tsang and Yip are suspected of accepting over 300 gifts worth approximately $3.2 million in total, including luxury watches, branded handbags and jewellery, as well as various household appliances and electronic products.
In view of this case, the ICAC has provided corresponding preventive measures for maintenance and procurement work, and joined hands with the EMSD to enhance integrity training for EMSD staff responsible for such procurement to avoid recurrence of similar incidents.
As the relevant bribery inquiries are ongoing, the ICAC would not rule out prosecuting other implicated individuals after seeking further legal advice from the DoJ.
The EMSD rendered full assistance to the ICAC during its investigation into the case.
