Then teacher jailed for fraud over government-aided special school teaching post by concealing ICAC probe

A then teacher of a government-aided special school, charged by the ICAC, was today (September 15) sentenced to imprisonment at the West Kowloon Magistrates’ Courts for deceiving the school into not suspending his duties by concealing that he was under investigation by the Commission, and preventing the termination of his employment by not disclosing that he had subsequently been charged.
Yau Sing-ho, 32, former assistant teacher of Lutheran School For The Deaf (Lutheran School), was sentenced to four weeks’ imprisonment. He was earlier found guilty after trial of three counts of fraud, contrary to section 16A(1) of the Theft Ordinance.
In sentencing, Magistrate Mr Jeffrey Sze Cho-yiu remarked that the school involved was publicly funded and that the public has expectations regarding the conduct of its teachers. The defendant had planned to deceive the school and caused significant damage to its reputation. Reprimanding the defendant for courting disaster, the magistrate noted that he could only blame himself, adding that a custodial sentence was imposed as it should be commensurate with the seriousness of the offences.
Lutheran School is a government-aided special school. According to the Education Bureau’s requirement, a teacher should declare whether he is under any criminal investigation or involved in any legal proceedings when applying for and assuming a teaching post, in order to uphold professional conduct and safeguard students’ well-being.
The court heard that in late July 2022, the defendant was employed by the school as a contract assistant teacher, and was offered a permanent post one year later. Prior to his application for the contract post, the defendant was under investigation for offences under and related to the Prevention of Bribery Ordinance and was arrested by the ICAC in September 2021. He reported to the ICAC on bail on several occasions and was charged in late November 2023. Following his conviction, he received a suspended sentence in February 2025.
While serving as a teacher at Lutheran School between late July 2022 and early December 2023, the defendant failed to disclose to the school that he was under criminal investigation by the ICAC or subject to criminal prosecution. With intent to defraud, he induced the school not to suspend his duties and not to terminate his employment.
The Education Bureau and Lutheran School rendered assistance to the ICAC during its investigation into the case.
The prosecution was today represented by prosecuting counsel Daley, Angel Mak, assisted by ICAC officer Keith Chan.
