Duo charged by ICAC with conspiracy to defraud for registering as electrical worker with false work experience

Following an investigation stemming from a corruption complaint concerning an application for registration as an electrical worker, an applicant and a registered electrical worker were charged by the ICAC today (September 22) with conspiracy to defraud. The duo had allegedly falsified the applicant’s work experience in the application lodged with the Electrical and Mechanical Services Department (EMSD) for the certificate.
Chui Shing-fok, 49, applicant for certificate of electrical worker registration; and Chan Kwok-wai, 45, then registered electrical worker employed by Kam Lok Disco Lighting & Sounds Company Limited (Kam Lok), face one count of conspiracy to defraud, contrary to the Common Law. They were released on bail, pending their appearance at the West Kowloon Magistrates’ Courts on Thursday (September 24) for plea.
Any person carrying out electrical works in Hong Kong is required to register with the EMSD as a Registered Electrical Worker. The registration certificate is categorised into five grades, with Grade A (commonly known as Grade A Electrical Work Certificate) being the entry-level qualification. Applicants must have at least five years of work experience in electrical engineering companies, including a minimum of one year working under the supervision of a registered electrical worker, and submit relevant supporting documents for the EMSD’s assessment.
Chui filed an application with the EMSD for a Grade A Electrical Work Certificate in mid-2021, but the EMSD considered his proofs incomplete and requested further information.
The charge alleges that between October 2022 and January 2023, the two defendants had conspired together with others to defraud the EMSD in respect of Chui’s application for a Grade A Electrical Work Certificate by submitting proof certified by Chan for Kam Lok without its authorisation containing false work experience for Chui, causing the EMSD to issue the certificate to Chui.
It is alleged that Chui had represented to the EMSD that he had worked as an electrical worker at Kam Lok for over four years, under the supervision of Chan, a Registered Electrical Worker, and submitted a letter of proof purportedly certified by Chan. However, the ICAC investigation revealed that Kam Lok had never employed Chui, and Chan had never been authorised to certify the letter.
When an applicant registers as an electrical worker with false work experience, it could undermine the quality of the electrical works performed and jeopardise public safety. The ICAC had made corruption prevention recommendations to the EMSD regarding the registration and regulation of electrical contractors and workers. The EMSD has implemented the recommendations and revoked the certification of the applicant in this case. The ICAC continues to collaborate with the EMSD to enhance integrity in the industry to prevent any illegalities and irregularities.
The EMSD and Kam Lok rendered full assistance to the ICAC during its investigation into the case.
