Man brought to court for alleged breach of POBO by disclosing identity of person under ICAC probe

A man was brought to the Eastern Magistracy today (March 6) after being charged by the ICAC for allegedly breaching the Prevention of Bribery Ordinance (POBO) by disclosing the identity of a person under investigation.

Yip Kwan-wah, 31, who was charged yesterday (March 5), faced one count of disclosing the identity of a person being investigated, contrary to Section 30(1)(a) of the POBO.

No plea was taken today. Principal Magistrate Ms Bina Chainrai adjourned the case until April 17 for plea.

The case arose from a corruption investigation. Subsequent ICAC enquiries revealed the above alleged offence.

Since January 2016, the defendant has been remanded in jail custody for his alleged involvement in a dangerous drugs trafficking case.

The charge alleged that on March 7, 2017, the defendant, knowing or suspecting that an investigation in respect of an offence alleged or suspected to have been committed under Part II of the POBO was taking place, without lawful authority or reasonable excuse, disclosed to a woman visiting him at a prison that she was the subject of the investigation.

The Correctional Services Department had rendered full assistance to the ICAC during its investigation.

The prosecution was today represented by ICAC officer Chik Che-hang.
