General manager of pipeline company in court for $860,000 contract fraud

The general manager of a pipeline engineering company appeared in the Eastern Magistracy today (May 4) after being charged by the ICAC with conspiracy to defraud the incorporated owners (IO) and the property management company of a residential building in Central by submitting false tender documents to secure its drainage works contract at about $860,000.

Chan Wai-kin, 41, general manager of Hing Yip Pipeline Service Limited (HYP), who was charged on Wednesday (May 2), faced one count of conspiracy to defraud, contrary to common law.

No plea was taken today. Principal Magistrate Mr Peter Law Tak-chuen adjourned the case to June 14 for plea.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offence.

At the material time, the defendant was the general manager of HYP, which engaged in drainage engineering works.

In January 2016, flat owners of Wise Mansion, a private residential building in Robinson Road, Central, resolved to conduct drainage works at the building. The property management company of Wise Mansion later acted on behalf of its IO to invite interested bidders to visit the building for site inspection and collect tender documents for the drainage works.

The charge alleged that between an unknown day in February and February 22, 2016, the defendant conspired together with two then employees of HYP to defraud the IO of Wise Mansion and its property management company by dishonestly:

(i) falsely representing that the two employees of HYP had attended Wise Mansion for a site visit concerning its drainage works as representatives of an engineering company and a drainage company respectively;

(ii) submitting a set of false tender documents in the name of the engineering company bidding for the drainage works; and

(iii) causing the IO of Wise Mansion to award the contract of the drainage works to HYP.

ICAC enquiries revealed that the drainage works contract was awarded to HYP at about $860,000.

The defendant was granted cash bail of $5,000. He was ordered not to leave Hong Kong, report to the Police twice a week, and not to contact prosecution witnesses directly or indirectly.

The IO of Wise Mansion and its property management company had rendered full assistance to the ICAC during its investigation.

The prosecution was today represented by ICAC officer Wong Ching-kwong.
