Duo charged with bribery and fraud over purchase orders for lighting equipment

A former technician of a property management company and a director of a lighting equipment supplier have been charged by the ICAC today (June 29) with respectively conspiracy to defraud the company of over $170,000 worth of purchase orders for lighting equipment, and bribing the former technician with about $50,900 to secure its purchase orders.

Danny Ma Chor-fai, 49, former technician of Kai Shing Management Services Limited (KSM), faces one count of conspiracy to defraud, contrary to Common Law.

Co-defendant Kam Yuen-hung, 45, director of Hong Kong LED Lighting Limited (HKLL), faces one count of conspiracy to offer advantages to an agent, contrary to Section 9(2)(a) of the Prevention of Bribery Ordinance and Section 159A of the Crimes Ordinance.

The defendants will appear in the Tuen Mun Magistracy next Wednesday (July 4) for plea.

At the material time, Ma was employed by KSM as technician to maintain facilities and procure work materials, including lighting equipment, for a private residential estate in Sham Tseng, Tsuen Wan, while Kam was the director of HKLL.

The charge alleges that between May 23, 2013 and September 21, 2015, Ma conspired together with two other employees of KSM to defraud the company by dishonestly:

(i) submitting or causing to be submitted a total of 68 false quotations purportedly provided by two lighting equipment companies;

(ii) falsely representing that the two lighting equipment companies had provided the quotations; and

(iii) causing KSM to order lighting equipment from HKLL.

ICAC enquiries revealed that KSM placed 68 orders with HKLL for purchasing lighting equipment in a total sum of over $170,000.

The other charge alleges that between an unknown day in August 2014 and January 29, 2016, Kam conspired together with Ma to, without lawful authority or reasonable excuse, offer a total of about $50,900 to Ma as rewards for causing KSM to place orders with HKLL.

KSM has rendered full assistance to the ICAC during its investigation into the case.

The defendants have been released on ICAC bail, pending their court appearance next Wednesday.
