Driver admits using false log book entries to deceive Government

A Motor Driver of the Social Welfare Department (SWD), charged by the ICAC, admitted at the West Kowloon Magistracy today (August 10) that he had used vehicle log books with false entries to deceive the Government in order to conceal his unauthorised absence from duty for performing a part-time job.

Lam Ping-fai, 55, pleaded guilty to eight charges of agent using document with intent to deceive his principal, contrary to Section 9(3) of the Prevention of Bribery Ordinance.

Acting Principal Magistrate Ms Ada Yim Shun-yee adjourned the case to August 24 for sentence, pending a community service order report. The defendant was granted bail.

The court heard that at the material time, the defendant, who was employed by the Government Logistics Department (GLD) as a full-time Motor Driver, was posted to the Emergency Relief Support Unit (ERSU) of SWD.

At the ERSU, the defendant was tasked to drive a truck to perform delivery service, and required to provide a daily record of his work by compiling a vehicle log book of SWD, including the times when he reported on and off duty.

Since 2008, the defendant had been employed by a subsidiary of a bus company as a part-time shuttle bus driver at the restricted area of the Hong Kong International Airport. He was required to punch his time cards at the subsidiary’s office at the airport when he reported on and off duty, and paid remuneration on an hourly basis.

The court heard that in late 2016, the ICAC investigated a corruption complaint against the defendant in relation to his false attendance records.

In examining entries on four vehicle log books of SWD and his time cards kept by the bus company’s subsidiary from January 1 to August 31, 2016, ICAC officers found that there were overlaps of his reported working hours of the two jobs on 37 days. The length of the overlapped periods ranged from nine minutes to 254 minutes, adding up to 59 hours and 33 minutes in total.

In order to cover up his unauthorised outside work, the defendant made a total of 47 entries in the four vehicle log books of SWD, falsely claiming that he was duly carrying out his duty as a Motor Driver, and submitted the log books to his supervisor on eight occasions.

SWD confirmed that the defendant was not on vacation leave or time-off during the periods of the false entries, the court was told.

SWD and GLD had rendered full assistance to the ICAC during its investigation into the case.
