Ex-sales manager charged with $200,000 renovation payments fraud

A former sales and marketing manager of a medical company has been charged by the ICAC today (January 30) with defrauding and attempting to defraud the company of payments amounting to $200,000 for its renovation works.

Chiu Sze-yan, 36, former sales and marketing manager of Hong Kong Wing Ming Medical Limited (Wing Ming), faces two charges – one of fraud, contrary to Section 16A of the Theft Ordinance, and one of attempted fraud, contrary to Section 16A of the Theft Ordinance and 159G of the Crimes Ordinance.

The defendant will appear at the West Kowloon Magistracy on Friday (February 1) for plea.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offences.

At the material time, the defendant was the sales and marketing manager of Wing Ming which engaged in the trading of Chinese medicine, health food and nutritional supplements. She was instructed by the operator of Wing Ming to engage a construction company to conduct renovation works for two newly rented shop units in a shopping centre in Yuen Long.

One of the charges alleges that between December 27, 2017 and January 2, 2018, the defendant falsely represented to Wing Ming that the price quoted by the construction company in respect of the renovation works of the shop units was $250,000, and with intent to defraud, induced Wing Ming to deposit $100,000 into a bank account in the name of her relative as initial payment for the renovation works, which resulted in benefit to her relative or prejudice to Wing Ming.

The other charge alleges that on January 22, 2018, the defendant made the same false representation in respect of the renovation works, and with intent to defraud, attempted to induce Wing Ming to issue a cheque for $100,000 as interim payment for the renovation works, which might result in benefit to her or prejudice to Wing Ming.

Wing Ming has rendered full assistance to the ICAC during its investigation into the case.

The defendant has been released on ICAC bail, pending her court appearance on Friday.
