Policeman and casual worker charged with HK$180,000 insurance fraud

A Police Constable and a casual worker have been charged by the ICAC with respectively conspiracy to defraud and attempting to defraud six insurance companies of compensations amounting to about HK$180,000, and making false reports to the Police.

Chim Kwong-shun, 36, Police Constable, and Tsang Hin-yeung, 29, casual worker, who were earlier charged, face six joint charges – two of conspiracy to defraud, contrary to Common Law, and four of attempted fraud, contrary to Section 16A of the Theft Ordinance and Section 159G of the Crimes Ordinance.

Chim alone faces five charges – two of fraud and three of attempted fraud, while Tsang alone faces three charges – one of conspiracy to defraud and two of conspiracy to make a false report of commission of offence, contrary to Section 64(a) of the Police Force Ordinance and Section 159A of the Crimes Ordinance.

The defendants will appear at the Eastern Magistracy tomorrow (February 1) for plea.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offences.

Chim has been a Police Constable of the Hong Kong Police Force (HKPF) since 2007. Prior to joining the HKPF, he was an insurance agent of Chubb Insurance Hong Kong Limited (Chubb). Chim was acquainted with Tsang.

Two of the charges allege that between June 18, 2014 and August 31, 2016, Chim and Tsang conspired together to defraud Dah Sing Insurance Company (1976) Limited (Dah Sing) by falsely representing to Dah Sing that Tsang had suffered property loss as stated in property claim forms and thereby inducing Dah Sing to accept the claims as genuine and pay compensation to Tsang.

Another charge alleges that between July 22, 2016 and January 23, 2017, Tsang conspired together with Chim to defraud AXA General Insurance Hong Kong Limited (AXA) by falsely representing to AXA that Tsang had suffered property loss as stated in the property claim form and thereby inducing AXA to accept the claim as genuine and pay compensation to Tsang.

Four other charges allege that between January 20 and September 18, 2017, Chim and Tsang falsely represented to AXA, Bank of China Group Insurance Company Limited (BOC) and MSIG Insurance (Hong Kong) Limited (MSIG) that Tsang had suffered property loss as stated in property or travel insurance claim forms, and with intent to defraud, attempted to induce the three insurance companies to accept the claims as genuine and pay compensation to Tsang.

Three other charges allege that between February 6, 2015 and July 3, 2017, Chim falsely represented to Hong Leong Insurance (Asia) Limited (Hong Leong) and AXA that he had suffered property loss as stated in home insurance or property claim forms, and with intent to defraud, attempted to induce Hong Leong and AXA to accept the claims as genuine and pay compensation to him.

Two other charges allege that between September 11, 2016 and January 13, 2017, Chim falsely represented to BOC and Chubb that he had suffered property loss as stated in travel insurance claim forms, and with intent to defraud, induced the two insurance companies to accept the claims as genuine and pay compensation to him.

The remaining two charges allege that on June 18, 2014 and February 6, 2015, Tsang respectively conspired together with Chim to knowingly make to the HKPF a false report of the commission of an offence that Tsang had suffered property loss due to theft in Hong Kong.

As a result of the above alleged false claims, Chim and Tsang had conspired to defraud and attempted to defraud the six insurance companies of compensations totalling about HK$180,000.

The HKPF, Dah Sing, AXA, BOC, MSIG, Hong Leong and Chubb have rendered full assistance to the ICAC during its investigation into the case.

The defendants have been released on ICAC bail, pending their court appearance tomorrow.
