Director jailed for bribery over purchase orders for lighting equipment

A director of a lighting equipment supplier, charged by the ICAC, was today (February 22) sentenced to 10 weeks’ imprisonment at the Tuen Mun Magistracy for bribing a former technician of a property management company with $43,000 to secure its purchase orders for lighting equipment.

Kam Yuen-hung, 46, director of Hong Kong LED Lighting Limited (HKLL), earlier pleaded guilty to one count of conspiracy to offer advantages to an agent, contrary to Section 9(2)(a) of the Prevention of Bribery Ordinance (POBO) and Section 159A of the Crimes Ordinance.

In sentencing, Magistrate Jacky Ip Kai-leung said the offence committed by the defendant was serious in nature as he offered illegal rebates to an agent on a number of occasions in a period of time.

The magistrate also said he reduced the starting point of five months in jail to 10 weeks after taking into account the defendant’s guilty plea, clear record and assistance rendered to the prosecution in testifying against a co-defendant in another trial.

The court heard that at the material time, Kam was a director of HKLL, a supplier of lighting equipment. Danny Ma Chor-fai was employed by Kai Shing Management Services Limited (KSM) as technician to maintain facilities and procure work materials, including lighting equipment, for a private residential estate in Sham Tseng, Tsuen Wan.

In 2013, Ma came to know Kam and started to place purchase orders for lighting equipment with HKLL for the estate. One year later, Ma asked Kam to offer rebates to him for placing order with HKLL.

Between late 2014 and January 29, 2016, upon Ma’s solicitations, Kam had offered him rebates of $4,000 to $20,000, totalling $43,000, on five separate occasions, as advantages to secure future orders from KSM to HKLL.

Ma, 49, who was also charged by the ICAC for his role in the case, was earlier sentenced to nine months’ imprisonment for conspiracy to accept illegal rebates totalling $43,000 for causing KSM to place purchase orders for lighting equipment with HKLL, and defraud KSM of over $170,000 worth of purchase orders.

KSM had rendered full assistance to the ICAC during its investigation into the case.

The prosecution was today represented by prosecuting counsel Stephen Ma, assisted by ICAC officer Karmen Cheung.
