Ex-senior manager charged with bribery and fraud over IT contracts

A former senior information technology (IT) manager of a hotel has been charged by the ICAC today (March 1) with soliciting bribes of over $368,000 from a contractor for assisting the latter in securing IT service contracts from the hotel, defrauding the hotel of IT service contracts worth over $439,000 and making a false claim of a service fee.

Wilson Leung Chin-wai, 37, former senior IT manager of Victoria Park Hotels Limited (VPHL) trading in the name of The Park Lane Hong Kong (PLHK), faces five charges – three of agent soliciting an advantage, contrary to Section 9(1)(a) of the Prevention of Bribery Ordinance; and two of fraud, contrary to Section 16A(1) of the Theft Ordinance.

The defendant will appear at the Eastern Magistracy next Tuesday (March 5) for transfer to the District Court for plea.

At the material time, the defendant was a senior IT manager of VPHL and oversaw the daily operation of the IT Department of PLHK. In October 2014, the defendant set up W’s International Group Limited (WIGL), an IT company, of which he was the sole director and shareholder.

Three of the charges allege that between December 20, 2016 and May 16, 2017, the defendant, without lawful authority or reasonable excuse, solicited bribes totalling over $368,000 from the proprietor of an approved IT contractor of PLHK as rewards for assisting the contractor in securing IT service contracts from PLHK.

Another charge alleges that between July 5, 2016 and August 31, 2017, the defendant concealed from VPHL that he was the sole director and shareholder of WIGL, and with intent to defraud, induced VPHL to award 20 IT service contracts to another approved IT contractor of PLHK, which resulted in benefit to WIGL or prejudice to VPHL. The 20 IT service contracts were worth over $439,000.

The remaining charge alleges that between July 26 and September 30, 2016, the defendant falsely represented to VPHL that the service of the above approved IT contractor was required for disassembling 80 sets of computers, and with intent to defraud, induced VPHL to engage the contractor for disassembling those computers, which resulted in benefit to WIGL or prejudice to VPHL. The alleged false claim of a service fee amounted to $4,800.

VPHL has rendered full assistance to the ICAC during its investigation into the case.

The defendant has been released on ICAC bail, pending his court appearance next Tuesday.
