Six former HyD subcontractor staff charged over false road inspection reports

Six former assistant road inspectors of a subcontractor of the Highways Department (HyD) have been charged by the ICAC today (November 26) with conspiracy to defraud the HyD by submitting road inspection reports containing photographs falsely representing conditions of roads.

Kwan Siu-hang, 29, Lam Hung-fai, 30, Kwong Chun-ho, 29, Lo Ting-fung, 28, Lam Chi-shing, 27, and Lee Yin-hong, 31, all former assistant road inspectors of Wah Fung Engineering Company Limited (Wah Fung), each faces one count of conspiracy to defraud, contrary to Common Law.

The defendants will appear at the Eastern Magistracy on Thursday (November 28) for plea.

The case arose from a corruption complaint referred by the HyD. Subsequent ICAC enquiries revealed the above alleged offences.

In 2017, the HyD awarded a term contract to Chiu Hing Construction and Transportation Company Limited (Chiu Hing), which then subcontracted related works to Wah Fung.

Under the contract, Chiu Hing was required to deploy road inspectors to conduct regular road inspections in Hong Kong Island and prepare reports supported by real-time photographs of the roads taken during the inspections.

At the material time, the defendants were employed by Wah Fung as assistant road inspectors to carry out road inspection.

The charges allege that between May and October 2017, the defendants respectively conspired together with some staff members of Chiu Hing and Wah Fung to defraud the HyD by dishonestly submitting road inspection reports containing photographs of roads which were not taken on the dates specified on the photographs.

The staff members concerned were a project manager of Chiu Hing, as well as an assistant to network manager, a senior site agent and three road inspectors of Wah Fung.

The defendants have allegedly induced the HyD to accept the actual conditions of the roads on the dates as specified on the photographs were as depicted in them.

The HyD has rendered full assistance to the ICAC during its investigation.

The defendants have been released on ICAC bail, pending their court appearance on Thursday.
