Secondary school teacher charged with fraud over 2018 HKDSE appointment

A secondary school teacher has been charged by the ICAC today (November 28) with fraud for falsely declaring to the Hong Kong Examinations and Assessment Authority (HKEAA) that he had no teaching duties in a tutorial school during his appointment as Waiting Room Supervisor for the 2018 Hong Kong Diploma of Secondary Education Examination (HKDSE).

Chan Yiu-fai, 40, Graduate Master of a secondary school, faces one count of fraud, contrary to Section 16A of the Theft Ordinance.

The defendant will appear at the Eastern Magistracy next Monday (December 2) for plea.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offence.

At the material time, the defendant was employed by a secondary school as a Graduate Master teaching English to senior class students. He was also employed by a tutorial school to perform various teaching duties in its teaching centres.

In May 2018, the secondary school was engaged by the HKEAA to serve as an examination centre for the English Language Speaking Examination of the 2018 HKDSE. Prior to the examination, the defendant was nominated by the secondary school to be a Waiting Room Supervisor.

The charge alleges that between March 19 and April 19, 2018, the defendant made a false declaration by deceit on an acceptance form submitted to the HKEAA that he did not have any teaching duties in a tutorial school, and with intent to defraud, induced the HKEAA to confirm his appointment as Waiting Room Supervisor for the abovementioned examination.

It is alleged that the false declaration resulted in benefit to the defendant an honorarium of $3,780 for performing as Waiting Room Supervisor, and prejudice to the HKEAA by appointing a person having teaching duties in a tutorial centre as Waiting Room Supervisor.

The HKEAA and the secondary school have rendered full assistance to the ICAC during its investigation into the case.

The defendant has been released on ICAC bail, pending his court appearance next Monday.
