Two Chinese medicine practitioners charged with sick leave certificate fraud

Two Chinese medicine practitioners have been charged by the ICAC today (August 31) with defrauding a Chinese medicine clinics group of granting sick leave by issuing and using a false sick leave certificate.
Tsang Hin-hei, 34, Chinese medicine practitioner formerly employed by GraceMed Management Limited (GraceMed), faces one count of agent using document with intent to deceive his principal, contrary to Section 9(3) of the Prevention of Bribery Ordinance.
Lam Tsz-fung, 37, Chinese medicine practitioner and proprietor of Ming An Tang, faces one count of forgery, contrary to Section 71 of the Crimes Ordinance.
The defendants will appear in the West Kowloon Magistrates’ Courts on Wednesday (September 2) for plea.
At the material time, Tsang was a Chinese medicine practitioner employed by GraceMed which managed a number of Chinese medicine clinics. Tsang was required to work on Mondays, Wednesdays and Fridays at a clinic of GraceMed in Ma On Shan, and was entitled to two paid sick leave days per month.
Lam, another Chinese medicine practitioner, was the proprietor of Ming An Tang, a Chinese medicine clinic in Sham Shui Po.
The charge against Tsang alleges that on an unknown date between March 6 and 19, 2019, Tsang used a sick leave certificate which contained a false or erroneous statement, namely that he attended Ming An Tang on March 1, 2019 for medical consultation, to mislead GraceMed.
The charge against Lam alleges that on or about March 1, 2019, Lam made a sick leave certificate in relation to Tsang which was false, namely Tsang attended Ming An Tang for medical consultation on March 1, 2019, with the intention to induce somebody to accept it as genuine.
It is alleged that the sick leave certificate concerned would facilitate Tsang to obtain salary totalling over $4,900 for two paid sick leave days.
GraceMed has rendered full assistance to the ICAC during its investigation into the case.
The defendants have been released on ICAC bail, pending their court appearance on Wednesday.
