ICAC Statement

The ICAC today (December 12) issued the following statement:

“Following receipt of complaints, the ICAC had conducted investigation into various allegations of corruption and misconduct in public office against Mr Leung Chun-ying, former Chief Executive of the Hong Kong Special Administrative Region and Mr Holden Chow Ho-ding, a member of the Legislative Council (Legco). The allegations arose from (i) Leung’s entering into an agreement with UGL Limited and receiving payments pursuant to the agreement, and (ii) suspected interference by Leung and Chow with the inquiry of the “Select Committee to Inquire into Matters about the Agreement between Mr Leung Chun-ying and the Australian firm UGL Limited” of the Legco. The findings of the investigation were submitted to the Department of Justice (DoJ) for legal advice. The DoJ considered that there is insufficient evidence to support a reasonable prospect of conviction against the above-mentioned persons for any criminal offence.

In accordance with established procedures, the ICAC today (December 12) submitted an investigation report to the independent Operations Review Committee (ORC), which oversees ICAC investigations. After considering the report and the legal advice given, the ORC endorsed that no further investigative action should be taken by the ICAC.

The ICAC notes that the DoJ will issue a statement outlining the main reasons for the decision of not instituting prosecution against the persons involved in the case.”
