Duo charged with conspiracy to defraud over decoration project of footwear retailer

A former employee of a footwear retailer and a production company operator were yesterday (April 8) charged by the ICAC with conspiracy to defraud over a decoration project of the footwear retailer.
Wong Wai-shing, 47, former assistant project and visual merchandising manager of Skechers Hong Kong Limited (Skechers); and Chan Chung-wai, 46, operator of Show Easy Company (Show Easy) and Banner 1, jointly face one count of conspiracy to defraud, contrary to Common Law. Wong further faces one count of forgery, contrary to Section 71 of the Crimes Ordinance.
The defendants will appear at the Kwun Tong Magistrates’ Courts next Monday (April 12) for plea.
The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offences.
At the material time, Wong was responsible for conducting quotation exercises for selecting contractors to take up decoration works for branches of Skechers.
One of the charges alleges that between November 30 and December 21, 2017, Wong and Chan conspired together to defraud Skechers by dishonestly falsely representing that the quotations submitted by Show Easy and Banner 1 for a decoration project of Skechers were genuinely competitive ones, obtained through a competitive process, and prepared separately from and independently of each other, thereby deceiving Skechers into granting the project to Show Easy.
Another charge alleges that on or about December 20, 2017, Wong made a false instrument, namely an email purportedly sent by Chan, with intention to use it to induce the vice president of Skechers to accept it as genuine.
ICAC inquiries revealed that Show Easy and Banner 1, both operated by Chan, had allegedly submitted quotations of about $300,000 to Skechers for the aforesaid decoration project, and WONG had allegedly recommended Show Easy to take up the project in view of its slightly lower price than that of Banner 1.
Skechers has rendered full assistance to the ICAC during its investigation into the case.
The two defendants have been released on ICAC bail, pending their court appearance next Monday.
Arising from the same investigation, Chan Yu-hang, 37, former assistant shop in-charge of an audio-visual products retailer, was charged with fraud, forgery, using a false instrument and conspiracy to forge a document in relation to the renovation works of two branches of Skechers. He has also been released on ICAC bail, pending his appearance at the Kwun Tong Magistrates’ Courts next Monday for plea.
