Ex-IO treasurer charged with fraud over $165,000 secretarial service fees

A former treasurer of the incorporated owners of a private residential building in Sham Shui Po has been charged by the ICAC today (April 29) with deceiving the incorporated owners into paying service fees for almost 14 years totalling about $165,000 by falsely representing that a part-time clerk was employed.

Tam Bing-vun, 79, former treasurer of the incorporated owners of Cheung Sha Mansion (the IO), faces one count of fraud, contrary to Section 16A of the Theft Ordinance.

The defendant will appear in the West Kowloon Magistrates’ Courts next Monday (May 3) for plea.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offence.

Between 2002 and 2018, the defendant was the treasurer of the IO. In September 2003, the IO resolved to employ a part-time clerk to handle its secretarial matters.

The charge alleges that between October 1, 2003 and June 26, 2017, the defendant falsely represented to the IO that a part-time clerk was employed for providing secretarial services and a monthly secretarial service fee of $1,000 was payable to the clerk, with intent to defraud, induced the IO to approve the payment of monthly secretarial service fee, which resulted in benefit to the defendant or in prejudice to the IO.

It is alleged that the IO paid secretarial service fees totalling about $165,000 in almost 14 years.

The IO has rendered full assistance to the ICAC during its investigation into the case.

The defendant has been released on ICAC bail, pending his court appearance next Monday.
