Two defeated candidates of 2019 DC Election charged with failing to lodge election returns

Two defeated candidates of the 2019 District Council (DC) Election were charged by the ICAC in separate cases with failing to lodge an election return as required by the Elections (Corrupt and Illegal Conduct) Ordinance (ECICO).

The ICAC investigations arose from referrals by the Registration and Electoral Office (REO). After seeking legal advice from the Department of Justice, Chan Yu-ming, 41, software engineer; and Ng Chi-hung, 55, retired; were each charged with one count of failing to lodge an election return as required under Section 37 of the ECICO, contrary to Section 38 of the ECICO.

The defendants will appear in the Kwun Tong Magistrates’ Courts tomorrow (June 4) for plea in two cases.

The 2019 DC Election was held on November 24, 2019. The statutory deadline for candidates to submit election returns to the REO was December 29, 2019.

In the first case, the charge alleges that Chan, being a candidate at the 2019 DC Election for the Pak Nga Constituency of Kwun Tong District, failed to lodge an election return as required under Sections 37(1), (1F) and (1G) of the ECICO.

In the second case, the charge alleges that Ng, being a candidate at the 2019 DC Election for the Kam To Constituency of Sha Tin District, failed to lodge an election return as required under Sections 37(1), (1F) and (1G) of the ECICO.

The REO has rendered full assistance to the ICAC during its investigation into the cases.

The defendants have been released on ICAC bail, pending their court appearance tomorrow.
