Former construction worker charged with bribery and fraud

A former construction worker was yesterday (June 16) charged by the ICAC with bribery and fraud over the employment and contribution of the Mandatory Provident Fund (MPF) concerning two fellow construction workers.

Chan Ki-lok, 26, former construction worker of Asian Projects Company Limited (Asian Projects), faces four charges – one of agent accepting an advantage and two of agent soliciting an advantage, all contrary to Section 9(1)(a) of the Prevention of Bribery Ordinance. He also faces one count of fraud, contrary to Section 16A of the Theft Ordinance.

The defendant will appear in the Tuen Mun Magistrates’ Courts tomorrow (June 18) for plea.

At the material time, the defendant was a construction worker of Asian Projects, which was a construction contractor of a project in Tuen Mun.

One of the bribery charges alleges that on November 8, 2019, the defendant, without lawful authority or reasonable excuse, accepted $1,000 from a fellow construction worker as an inducement to or reward for assisting the latter to secure his employment with Asian Projects.

Two other bribery charges allege that on December 1 and 11, 2019, the defendant, without lawful authority or reasonable excuse, solicited from the aforesaid construction worker $650 on each occasion for the same purpose.

The remaining charge alleges that between September 24, 2019 and January 18, 2020, the defendant falsely represented to another fellow construction worker that the latter had to pay him money for making MPF contribution, with intent to defraud, induced the latter to pay a total of $5,800 to him, which resulted in benefit to him or in prejudice to that construction worker.

Asian Projects has rendered full assistance to the ICAC during its investigation into the case.

The defendant has been released on ICAC bail, pending his court appearance tomorrow.
