Magistrate sends man charged by ICAC to one year’s jail for managing drug divan after review of sentence

A man, who was charged by the ICAC for managing a divan where heroin and “ice” were sold, was today sentenced to one year’s imprisonment after a Principal Magistrate reviewed his sentence. The defendant was earlier ordered to undergo treatment at a drug addiction treatment centre upon his guilty plea to the offence revealed in the course of a corruption investigation.
Tsoi Ko-ming, 58, earlier pleaded guilty to one count of managing a divan. On July 8, 2022, he was sentenced by Principal Magistrate Ms Bina Chainrai of the Kwun Tong Magistrates’ Courts to undergo treatment at a drug addiction treatment centre.
The Department of Justice (DoJ) subsequently made an application for a review of the defendant’s sentence. After reviewing his sentence, the Principal Magistrate today sentenced him to one year’s imprisonment.
The court heard that the defendant admitted that between March and April 2018, he had managed a divan in Kwun Tong where dangerous drugs, namely heroin and “ice”, were sold to be smoked, inhaled, ingested or injected in the divan.
The ICAC investigation arose from a corruption complaint. Upon legal advice sought from the DoJ, the above charge was laid against the defendant.
The prosecution was today represented by Senior Public Prosecutor Peggy Leung, assisted by ICAC officer Tim Leung.
