Defendant in impersonation of ICAC officer case faces additional perversion charges

A defendant earlier charged by the ICAC for impersonation of its officer was laid with five additional charges of perverting the course of public justice by uploading five closed circuit television (CCTV) footages in relation to the case onto a social media platform before the trial, alleging that prosecution witnesses had fabricated the footages against him.
Tam Wing-park, 67, merchant, was laid with five additional charges of perverting the course of public justice, contrary to Common Law. He was earlier charged with three counts of falsely pretending to be an officer of the ICAC, contrary to Section 13C(a) of the Independent Commission Against Corruption Ordinance. A pre-trial review is scheduled for tomorrow (April 4) at the West Kowloon Magistrates’ Courts while the defendant will enter plea on the perversion charges.
The girlfriend of the defendant was involved in a traffic collision and a civil claim was initiated against her by the employer of the other driver concerned in 2020. She was subsequently ordered by the Small Claim Tribunal to compensate the driver’s employer. Afterwards, the defendant allegedly impersonated an ICAC officer to request three clinic staff to verify medical certificates of the driver.
The defendant had never been an officer of the ICAC. He was charged by the ICAC with three counts of falsely pretending to be an officer of the ICAC on October 19, 2022. He pleaded not guilty to the charges in court on December 16, 2022, and was granted bail pending trial.
The prosecution served the defendant with the relevant trial materials, including relevant CCTV footages of the clinic concerned, bearing a watermark “Defence Copy”, capturing images and voices of various prosecution witnesses.
It is alleged that on or about December 22, 2022, the defendant did a series of acts with intent to pervert the course of public justice. He allegedly uploaded five video clips onto a social media platform before the trial of the impersonation of ICAC officer case. The video clips mentioned five of the prosecution witnesses of the case and contained assertions that the five people had fabricated CCTV footages for the prosecution against the defendant.
ICAC enquiries revealed that the video clips contained CCTV footages of the clinic bearing a watermark “Defence Copy”. Personal particulars of the prosecution witnesses were also mentioned in the video clips.
An ICAC spokesperson notes that perverting the course of public justice is a serious offence. An offender is liable on conviction to an imprisonment for any term and a fine of any amount. Should such illegal acts be found in ICAC cases, the Commission would not tolerate them and would follow up on them in a serious manner.
The clinic concerned has rendered full assistance to the ICAC during its investigation into the case.
