Sub-contractor in 3RS Project’s sub-contracts corruption case faces three additional charges

The proprietor of a sub-contractor of the Three-Runway System Project (3RS Project) of the Hong Kong International Airport was laid with three additional corruption charges involving bribes of $2.7 million. The proprietor and a former General Manager of the Airport Authority Hong Kong (AAHK) were among 10 people earlier charged by the ICAC over sub-contracts of the 3RS Project. The total bribe money involved in the cases had amounted to around $7.7 million, concerning works sub-contracts and materials purchase orders worth over $260 million in total.

Ng Kai-on, 66, proprietor of Carol Engineering Limited (CEL), a sub-contractor of the 3RS Project, was further laid with three charges when he appeared at the Eastern Magistrates’ Courts for mention today (April 14). The charges are two of offering an advantage to an agent and one of conspiracy to offer an advantage to an agent.

The additional charges alleged that between January 2018 and January 2022, Ng offered $300,000 and $2.3 million to a deputy general manager and a project manager of a contractor of the reclamation works of the 3RS Project respectively for assisting CEL to secure a sub-contract for additional filling for the area under sloping seawall, or assisting CEL to demand payments from the contractor for the works done by it. The sub-contract concerned was worth about $83 million in total.

It is also alleged that in July 2022, Ng conspired together with a CEL’s project manager to offer $100,000 to a works manager of the above contractor for assisting CEL in carrying out works under the abovementioned reclamation works of the 3RS Project.

Ng and Yin Kek-kiong, 62, former General Manager of the AAHK, were laid with an additional charge of conspiracy for a public servant to accept an advantage involving a Mainland residential property last week.

The ICAC arrested various people on suspicion of corruption in operation “Blizzard” mounted in mid-August last year and subsequently charged 10 people with multiple counts of bribery, money laundering and theft in five cases. Four of the cases involving nine defendants, including Ng and Yin, were adjourned to June 15 for mention at the Eastern Magistrates’ Courts, pending the prosecution’s application for transferring the cases to the District Court.

The remaining case concerned Joint Field Engineering Limited, a supplier of sand for reclamation works of the 3RS Project. Its operator Wong Bun-hon and sole director-cum-shareholder Wong Yu-hang faced one count of conspiracy to steal. The duo did not enter any plea when they appeared at the Eastern Magistrates’ Courts for mention today. Their case was further adjourned to June 23 for mention.

The ICAC will continue to maintain close liaison with the AAHK, which has rendered full assistance to the ICAC during its investigation into the cases. While corruption enquiries are continuing, the ICAC does not rule out further law enforcement actions and further prosecutions.
