The Court of Final Appeal today (Wednesday) dismissed the application of a Bailiff's Assistant to further appeal against his conviction for using documents with false information which purportedly showed that he had attempted to serve court summonses.

Ng Chi-kin, 37, was sentenced by a magistrate to four months' imprisonment, suspended for 12 months, in May 1999.

Ng was found guilty by a magistrate on three counts of using documents which contained false statements to mislead the Judiciary between December 1996 and May 1997, and two counts of falsifying claims for travelling allowances for serving summonses.

The trial magistrate had remarked that the offences committed by Ng represented a breach of trust and acts of dishonesty to the Government and to the public.

Ng lodged an application to the Court of Appeal in November last year on various grounds, including the allegation that he was given unfair treatment by the ICAC during the investigation.

Justice Clare Beeson ruled in her judgement that there was nothing in the evidence before her to support the allegations made against the ICAC.

Ng today applied for leave to the Court of Final Appeal on similar grounds. Mr Justice Litton, Mr Justice Ching and Mr Justice Bokhary unanimously rejected his application.

The prosecution was today represented by Senior Government Counsel Alex Lee, assisted by ICAC officer Blanche Yiu.
