Jail sentences for ex-agents convicted of insurance fraud

Two former insurance agents, charged by the ICAC, received jail sentences for their roles in an insurance scam involving false claims of $340,000 from eight insurance companies.

The claims were supported by fictitious accident and Mainland hospitalization records as well as false documentation from bogus employers.

Kwok Tin-loi, 40, formerly employed by both Top Glory Insurance Company (Bermuda) Limited (Top Glory) and AIA Insurance (Bermuda) Limited, received a jail term of two years, while Yeung Tsan-ying, 37, formerly employed by Top Glory, was sentenced to 12 mo nths ’ imprisonment, suspended for three years.

In sentencing, District Court Deputy Judge Tong said the offences committed by Kwok were serious and constituted a breach of trust, so an immediate custodial was warranted.

The judge also said he passed a suspended sentence on Yeung because she had played a lesser role in the scam. The judge added that he had taken into consideration her probation reports.

Kwok had earlier pleaded guilty to a total of 13 counts of conspiracy to defraud and procuring the execution of a valuable security by deception, while Yeung was convicted of two counts of conspiracy to defraud.

The court heard that Kwok had falsely represented that a number of persons had applied for insurance policies with the insurance companies concerned, and that they had sustained injuries from accidents and received medical treatment.

Kwok had also conspired with others to defraud the insurance companies by submitting forged employment records and falsely representing that a number of persons had sustained injuries from work.

Yeung was found guilty of two counts of conspiring with others to make false insurance claims.

The offences took place between October 1994 and March 1997.

The eight insurance companies defrauded by the defendants were Top Glory, QBE Insurance (Hong Kong) Limited, National Mutual Insurance Company (Bermuda) Limited, The Ming An Insurance Company (Hong Kong) Limited, Jardine CMG Life Assurance Limited, East A sia Aetna Insurance Group, Bank of China Group Insurance Company Limited, and Dao Heng Insurance Company Limited.

The prosecution was today represented by Senior Government Counsel Anthony Kwok, assisted by ICAC officer Frankie Yuen.
