Four serving and former gully emptying team workers charged

Three serving and one former staff members of nightshift gully emptying teams of the Food and Environmental Hygiene Department (FEHD) were charged by the ICAC today (Wednesday) for allegedly defrauding the Hong Kong Government by falsifying work records a nd sick leave certificates.
Fu Chung-wing, 40, Kwok Kam-hoi, 46, Leung Yick-wai, 50, all Foremen, and Kou Sai-chung, 39, former Workman I, will appear at 9:30 am tomorrow (Thursday) in North Kowloon Court to face a total of 14 offences in two separate cases.
The cases originated from an ICAC investigation initiated as a result of a referral from the then Provisional Urban Council (PUC) last year, an ICAC spokesman said.
“ No evidence of corruption was revealed in the ICAC investigation. At its conclusion, a file of evidence was forwarded to the Department of Justice, which advised the above persons should be charged with related offences, ” the spokesman added.
In the first case, Fu, Kwok and Leung each faced one count of conspiracy to defraud.
Each of them was accused of conspiring with other persons to defraud the Hong Kong Government by falsely representing that gully emptying duties had been carried out in accordance with the work procedures of the FEHD, previously known as the Urban Service s Department (USD).
They had allegedly made false entries on vehicle log books of the Hong Kong Government and caused tap water rather than sludge to be unloaded at the West Kowloon Transfer Station between June 1, 1998 and January 26 last year.
In the second case, Kou, currently a garment worker, was charged with a total of 11 offences. He was alleged to have used false sick leave certificates to induce the then USD to accept them as genuine between December 20, 1996 and June 18, 1998.
In October last year, the then PUC referred to the ICAC a complaint alleging that members of the nightshift gully emptying teams had falsified work records and failed to carry out their duties, with the corrupt connivance of their supervisors.
At the time when the alleged offences took place, there were three gully emptying teams responsible for cleansing 5,200 gullies in the Kowloon region to prevent the incidence of flooding during rainstorms and reduce the risk of mosquito breeding in trappe d water.
Each team comprised five members - one Foreman as the team leader, one Special Driver to operate a gully emptier, one Motor Driver to drive a pick-up van and two Workmen I to carry out the cleansing work.
They were required to use the gully emptier to collect sand and grit from gully traps and unload them at the West Kowloon Transfer Station in Stonecutters Island.
